Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 01-102013 and the trial court has reported that charge against the petitioner was framed on 11-12-2014 but uptill now, not a single prosecution witness has turned up.

Learned counsel for the petitioner submits that as a matter of fact, the victim was major at the time of alleged occurrence and she left her home by her own sweet will but later on, she retreated from her previous stand and to save her married life, gave a false statement u/S 164 of the Cr. P.C.

Patna High Court Cr.Misc. No.31678 of 2015 (3) dt.16-10-2015 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dhanha P.S. Case No. 133 of 2013 corresponding to Sessions Trial No. 364 of 2014 to the satisfaction of learned Ad hoc Additional Sessions Judge-I, Bagaha, West Champaran.
