2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 109, 61(2) and 3(5) of the B.N.S. Act & Section 27 of the Arms ct.

3. The case of the prosecution is that the informant along with his nephew was going to Bhagalpur on a magic vehicle and as they reached near the Sadhu Baba Asthan, it is alleged that two persons on a bike intercepted their vehicle and one of the persons who has covered his face fired with pistol which hit in the chest of the informant. After this, both of them have fled away from the place of occurrence. The informant could not identify them as they had covered their face.

4. Learned counsel for the petitioner submits that the

Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced on the basis of CDR and the confessional statement of this petitioner. Learned counsel for the petitioner has also submitted that in this case, restatement of the informant and the statement of his nephew were recorded by the police but in both the statements, the name of the petitioner is not there. Even, in the confessional statement, it has been submitted by the petitioner that he was driving the bike and one other accused has fired. No legal material has come against the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 10.03.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sultanganj P.S. Case No. 97 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
