The petitioner, who is in custody, seeks bail in connection with Natwar P.S. Case No. 95 of 2017 registered for the offence punishable under Sections 20/21 of N.D.P.S. Act and Section 414 of Indian Penal Code.

Allegation against the petitioner is of recovery of 26 gram of Heroin with Puriya.

Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case and nothing has been recovered from the physical possession of the petitioner. It has been further submitted that seizure list has been prepared in absence of the petitioner and the name of

Patna High Court Cr.Misc. No.15677 of 2018(3) dt.12-04-2018 2/2 petitioner has come on the statement of Chaukidar and two arrested persons. It has further been submitted that coaccused, namely, Lakshmikant Singh, has already been granted bail by this Hon'ble Court by order dated 05.03.2018 passed in Cr. Misc. No. 7044 of 2018. It has further been submitted that petitioner has clean antecedent and he is in custody since 01.11.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Rohtas at Sasaram, in connection with Natwar P.S. Case No. 95 of 2017 (S. Kumar, J) veena/- U T
