2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 376, 506 and 34 of the Indian Penal Code and Sections 67 and 67 A of the Information Technology Act.

3. As per the prosecution case , there is allegation of commission of rape against co-accused Sonu Alam and this petitioner is alleged to have posted the obscene video and

4. Learned counsel for the petitioner submits that specific allegation of commission of rape is against co-accused Sonu Alam and so far as this petitioner is concerned, there is no allegation of sexual assault against him. The mobile in question from which the obscene videos and photographs were taken does not belongs to this petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State as well as informant opposed the bail petition of the petitioner and submits that petitioner is named in the F.I.R., with specific accusation that initially he tried to blackmail the victim on the basis of obscene videos and photographs and when he failed to do so , he uploaded the same on internet.

6. Considering the fact that there is no allegation of sexual assault against this petitioner and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate Araria in connection with Araria Mahila P.S. case No. 19 of 2024 , subject to the
