Petitioner, already in custody, seeks bail in connection with Ahiapur P.S. Case No.712 of 2017, registered under Sections 399, 402, 115 and 120(B) of the Indian Penal Code as well as under Sections 25(1-b)a, 26(ii) and 35 of the Arms Act. Learned counsel for the petitioner submits that there is recovery of one country made pistol with three live cartridges, petitioner is in custody since 06.09.2017, charge-sheet has been submitted in this case and the petitioner is on inimical terms with Kundan Singh against whom the petitioner had lodged a police case and thereafter Kundan Singh lodged the counter case and that is only criminal antecedent of the petitioner.

No.7333 of 2018(2) dt.07-02-2018 2/2 Having considered the said facts and circumstances, petitioner Avinash Kumar @ Avinash Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Ahiapur P.S. Case No.712 of 2017.
