Learned counsel for the petitioner submits that the facts of the present case is identical to the case of C.W.J.C. No. 22851 of 2013 (Raktima Rakshit Vs. The State of Bihar & Ors.) and Letters Patent Appeal No.394 of 2016 (State of Bihar & Ors. Vs. Raktima Rakshit), the aforesaid orders squarely cover the issue involved in the present case.

In such view of the matter, the concerned authority is directed to examine the facts and law of the case of petitioner and

Patna High Court CWJC No.6276 of 2016 (2) dt.11-09-2018 2 /2 if it is found that present case is squarely covered by the aforesaid case, the same benefit should also be extended to the petitioner. With the aforesaid observations and directions, this writ petition is disposed of.
