Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 448, 323, 341, 324, 325, 427, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of commission of injury to the deceased with Khanti. The allegation of commission of firearm injury is against other named accused persons. The Doctor has found three firearm wounds of entry on the person of the deceased which was cause of death. Besides the aforesaid, the Doctor found fracture of elbow joint caused by hard blunt substance.

Submission is that the allegation of commission

Patna High Court Cr.Misc. No.11128 of 2018 (3) dt.16-04-2018 2/2 of assault with lathi etc. is against 20 named persons which is general and omnibus. Moreover, the allegation against the petitioner is not supported by the medical report. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kajraili Police Station Case No. 23 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
