Although, learned counsel appearing for the petitioner tried to convince me about the innocence of the petitioner arguing that much prior to institution of the present case, the petitioner had given a Sanha before the S.D.M, Khagaria as the victim wanted to solemnize her marriage with the petitioner and furthermore, there is delay in lodging the first information report but I am not, at all, convinced with the above stated submission because the victim has clearly stated that she was raped by the petitioner while she had gone to take tuition in the house of the
