ANJANA MISHRA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.08.2018 in connection with G.O. Case No.743/2018 (arising out of Sindhwara (Singhwara) P.S. Case No.171 of 2018) registered for the offence under Section 30(a) of the Bihar Excise Prohibition Act.

The prayer of the petitioner was earlier rejected vide order dated 13.02.2019 with liberty to the petitioner to renew the prayer after six months from the order dated 10.12.2018 passed by this Court in Cr.Misc. No.71462 of 2018. A report had been called for from the court of the 2nd Additional Sessions-Cum-Special Judge, Darbhanga regarding the stage of the trial. It has been indicated therein

Patna High Court CR. MISC. No.47446 of 2019(6) dt.19-09-2019 2/2 that further six months' time is required for conclusion of the trial.

Considering the period of custody and the trial has not yet progressed substantially and the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IVcum-Special Judge, Darbhnaga, in connection with G.O. Case No.743/2018 arising out of Shindhwara (Singhwara) P.S. Case No.171 of 2018.
