2. The petitioner apprehends his arrest in connection with Buxar (M) P.S. Case No. 196 of 2021, registered for the offenses punishable under Section 30(a) of the Bihar Excise Act, 2018.

3. The allegation against the petitioner is of involvement in trade of illicit wine and he is said to be a member of a syndicate. The police on a secret informant came to know that some persons are carrying illicit wine through a vehicle, reached on the place of occurrence, however, it was found that the vehicle had already disappeared. In course of search, 187.260 liters of illicit liquor was recovered.

4. Learned Advocate for the petitioner submits that

No.51172 of 2026(2) dt.29-07-2026 2/3 the petitioner is carrying fair antecedent and it does not transpire from the record as to how the suspicion has been raised with regard to the complicity of the petitioner in crime and he is said to be one of the member of the syndicate. No materials were collected during the course of investigation which suggests his complicity. Save and except the petitioner is name lender in the FIR, there is nothing on record against him. The search and seizure has also been made without any complaince of the statutory prescription of the CrPC.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of the allegation, coupled with the fact that during the course of investigation nothing has surfaced which suggests the complicity of the crime, besides the fair antecedent, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Special Court No. 1, Buxar in

Case No. 196 of 2021, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
