Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already returned to her home and her statement under Section 164 of the Cr.P.C. was recorded. The victim stated that she had gone along with the petitioner by her own sweet will.

No doubt, the victim was found minor by the learned Magistrate, who recorded her statement but taking note of the aforesaid facts as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.32612 of 2015 (2) dt.17-08-2015 2/2 amount each to the satisfaction of Sri Suvash Kumar Roy, Judicial Magistrate 1st Class, Muzaffarpur/concerned court in connection with Piar P.S. Case No. 30 of 2015.
