JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2018 The learned counsel for the respondent Bank, on instruction, has submitted that the settlement arrived at before the National Lok Adalat in the year 2014 has failed inasmuch as the petitioner has failed to pay the amount crystallized by way of one time settlement. Thereafter, the petitioner neither paid the amount nor turned up, hence, the tractor was auctioned in the year 2016.

It is submitted by the learned counsel for the respondent that on account of the aforesaid facts, the present writ petition has become infructuous.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of as having become infructuous, however, with liberty to the petitioner to avail such other remedies as are available under the law in case any grievance subsists.
