====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-12-2019 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Special Case No. 01 of 2019 arising out of Vigilance P.S. Case No. 02 of 2019 for the offences punishable under Sections 7(a) of the Prevention of Corruption Act.
The allegation is regarding the petitioner having demanded money from the Urdu teacher, namely, Shagufta Naz Fatimi in order to release her salary, which was not being paid since a long time, whereafter the Vigilance has laid a trap and caught the petitioner red handed with the bribe money. The learned Senior counsel for the petitioner has submitted that the petitioner has been falsely implicated in the

No.46451 of 2019(4) dt.20-12-2019 2/2 present case, he has not accepted any bribe money from the aforesaid lady, as alleged, and the fact is that the salary of the complainant was pending for payment on account of her not submitting the necessary documents like educational qualification certificates, medical certificate etc. and on account of non-payment of the salary and with a personal grudge with the petitioner, the present case has been lodged in a mala fide manner. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 09.01.2019. The learned counsel for the Vigilance has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Vigilance-II, Patna in connection with Special Case No. 01 of 2019 arising out of Vigilance P.S. Case No. 02 of 2019.
