JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 This petition has been listed under the heading "to be mentioned" at the instance of petitioners submitting that uncle of the petitioners, who was unmarried has died on 07-09-2015 and father of the petitioners is very old and there is no any male member in their family to look after him and a prayer has been made for early hearing of this case.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. There is case and counter case between the parties and the allegation against petitioners and other accused is that they
Patna High Court Cr.Misc. No.32530 of 2015 (3) dt.14-09-2015 2/2 assaulted the informant and his family members and also opened fire but admittedly, no fire-arm injury has been found on the person of the injured of this case and except one injury, all the injuries of the injured are simple in nature. So far as grievous injury is concerned; the same has been found on the right elbow of the informant.
Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Telhara P.S. Case No. 64 of 2015 to the satisfaction of Smt. Rashmi Prasad, Judicial Magistrate-Ist Class, Hilsa, Nalanda.
