Petitioner, already in custody, seeks bail in connection with Jogbani P.S. Case No.156 of 2017, corresponding to Special (NDPS) Act Case No.23 of 2017, registered under Sections 21(b) and 22 of the NDPS Act.
Allegation in brief is that from the premises of the coaccused, Bhola Shankar Tiwary, some unauthorized drugs (cough syrup) containing narcotic substance were recovered and he disclosed that this was kept by the petitioner, tenant of the said room.
Learned counsel for the petitioner submits that the petitioner is not the tenant of the co-accused, Bhola Shankar
Patna High Court Cr.Misc. No.17324 of 2018(2) dt.27-03-2018 2/2 Tiwary, even the FIR reveals that there is no paper shown by Bhola Shankar Tiwary, the co-accused, showing the relationship of landlord and tenant and the petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Viren @ Virendra Mahto @ Viren Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cumSpecial (NDPS) Act Judge, Araria in connection with Jogbani P.S. Case No.156 of 2017, corresponding to Special (NDPS) Act Case No.23 of 2017.
