The petitioner is languishing in custody for the offences punishable under Sections 364, 120(B) of the I.P.C. Petitioner is under suspicion to have committed murder of the son of the informant as the petitioner had threatened in the past to commit the act alleged. Learned counsel for the petitioner submits that besides suspicion, there is no other evidence against the petitioner. Petitioner is in custody since 19.10.2020. Petitioner has got no criminal antecedent. Investigation of the case is already complete. The petitioner was never seen by any witness along with the deceased.

No.4020 of 2021(4) dt.27-07-2021 2/2 Learned counsel for the informant opposed the prayer for bail on the ground that this is a case of circumstantial evidence of last seen. Trial has already started. Considering the nature of material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Piprahi P.S. Case No. 209 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
