JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in connection with Sessions Trial No.573 of 2014 arising out of Parsa P.S. Case No. 104 of 2013 registered for the offences punishable under sections 25(1B)(a) and 26 of the Arms Act as also under sections 4 and 5 of the Explosive Substances Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 24.7.2014 passed in Cr. Misc. No.25027 of 2014 with following observation:
"The Chief Judicial Magistrate, Saran at Chapra is directed to expedite the trial and conclude the same as early as possible, preferably within seven months from the date of receipt/production of a copy of this order failing
Patna High Court Cr.Misc. No.37522 of 2015 (2) dt.19-08-2015 2/2 which the petitioner would be entitled to renew his prayer for bail."
It has been contended that though the petitioner is in custody since 28th September, 2013, till date not even a single witness has been examined on behalf of the prosecution. Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional District and Sessions Judge, Saran at Chapra in connection with Sessions Trial No.573 of 2014 arising out of Parsa P.S. Case No.104 of 2013.
