JUSTICE BIRENDRA KUMAR ORAL ORDER 12-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Section 418 of the Indian Penal Code and Sections 18C/27(b)(ii)/18(A)/28/36 AC Drugs and Cosmetics Act, 1940.

The petitioner was apprehended while he was carrying few bottles of Dialex-DC and some strips of Nitravet-10 tablets, which was containing narcotics. Petitioner is in custody since 25.12.2017 and has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

Patna High Court Cr.Misc. No.13846 of 2018 (2) dt.12-03-2018 P2/ two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kanhauli P.S. Case No.147 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
