JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the informant. Petitioners, already in custody, seek bail in Parbatta (Bharatkhand) PS Case No. 290 of 2016 registered under Sections 341, 323, 307 and 506/34 of the IPC.
The allegation in brief is that the accused persons due to land dispute came to the informant's house and started uprooting the Machan, when the informant's husband objected then they abused and Chandan gave an iron rod blow causing injury. Submission is that there is land dispute between both sides as well as case and counter case and the only specific allegation against these petitioners is of abusing the other side. Specific allegation of assault is against one Chandan Singh and not against these petitioners.
Having considered the said facts and circumstances, the petitioners, namely, Subhash Singh, Rupesh Singh and Chhango Singh @ Nitish Kumar are is directed to be released on bail on
Patna High Court Cr.Misc. No.2445 of 2018 (3) dt.18-01-2018 furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM I Khagaria in connection with Parbatta (Bharatkhand) PS Case No. 290 of 2016.
