JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-12-2022 Heard Ms. Pratima Kumari, learned counsel for the petitioner and Mr. Ashok Kumar Singh, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Desari PS Case No. 111/2022 registered for the offence punishable under Sections 341/323/307/506/34 of the IPC. As per First Information Report, the petitioner along with other accused persons arrived at the house of the informant and co-accused Ranjit Sahani fired upon the informant with the intention to kill him, but the bullet somehow crossed after touching near the left ear of the informant.
Learned counsel submits that the petitioner has got no criminal antecedent and he has falsely been implicated in this case on the basis of concocted story. He further submits that from perusal of the First Information Report, it would be
Patna High Court CR. MISC. No.48601 of 2022(2) dt.16-12-2022 2/2 evident that the allegation of assault by means of fire-arm is upon co-accused, Ranjeet Sahani and not upon the petitioner. Petitioner is in custody since 07.04.2022 and the charge-sheet has been submitted.
Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that allegation of firing is not upon the petitioner and the petitioner is in custody since 07.04.2022 having no criminal antecedent, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, RADAUR SAHANI @ DAHAUR SAHNI be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali/successor court in connection with Desari PS Case No. 111/2022.
