JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.1.2017 passed in Cr.Misc.No.49730 of 2016 with direction to learned trial court to expedite the trial and conclude it within a period of one year.

Submission of learned counsel for the petitioner is that one year period has already expired and only one witness has been examined as yet and petitioner is in custody since 24.6.2016. Heard learned APP also.

Having heard both sides and on perusal of report it appears that out of seven charge sheeted witnesses two have been examined, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial on regular basis and conclude the same within a further period

At the same time, Superintendent of Police, Bagaha is directed to ensure the presence of the witnesses in court so that the trial may be concluded within the said period. Further learned trial court is directed to submit monthly progress report of the trial to this Court so that this Court may aware about the stage of trial.
