JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and according to prosecution case, it was co-accused, Dharmendra @ Pappu who opened fire on the deceased. The impugned order of learned Additional Sessions Judge reveals that in course of investigation, the name of petitioner came in this case in supervision note of the Dy.S.P, who mentioned in his supervision note that petitioner had confessed his guilt before him in connection with another case and thereafter, he was remanded in this case.

Considering the aforesaid facts and circumstances as
