The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152 and 504 of the Indian Penal Code.
The prosecution case is that the informant being police officer received information on 18.12.2015 at 6.40 P.M. about the protest against the crushing of Yogendra Yadav by a truck, the police reached at the spot but the mob prevented the police from sending the dead body for autopsy. Under the leadership of Mithilesh Yadav the mob blocked the road and
Patna High Court Cr.Misc. No.25099 of 2016 (2) dt.20-06-2016 2/2 ultimately set ablaze the truck in question. Thirteen persons were caught on the spot who disclosed the names of escapees, the petitioner was one of them.
It is submitted by learned counsel for the petitioner that the accusation is against the mob. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur, District - Patna in connection with Dulhin Bazar P.S. Case No. 204 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
