No doubt, petitioner is named in the first information report but the informant claimed in his fardbeyan that at the time of alleged occurrence, co-accused Sunil Rai was carrying Dab in his hand and there was bloodstain on the aforesaid dab.

Moreover, according to the prosecution case itself, deceased had to depose in a criminal case instituted against the petitioner and others but submission on behalf of the petitioner is that the deceased as well as informant had already deposed in the above stated criminal case which is evident from annexure 2 to this petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
