2. This application for anticipatory bail arises out of Ara Nawada P.S. Case No. 833 of 2025, registered for the offence punishable under Sections 190, 191(2), 191(3), 109(1), 292 of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per the prosecution case, the informant has alleged that while his son, namely, Ankit Kumar, was returning home along with his friends after playing cricket and was passing through different locations, in the meantime, 5-6 unknown miscreants, covering their faces with mufflers, created ruckus and fired indiscriminately. During the said incident, one gunshot hit the victim on the back of his knee of left leg. Thereafter, his friend took him to Sadar Hospital, where one of

4. Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and has been falsely implicated in this case. It has further been submitted that during the course of investigation, co-accused Gyanendra Kumar @ Lalla was arrested and he confessed his guilt before the police, while in police custody, and stated that firearm injury was caused by co-accused Suraj Tiwary and the petitioner and other co-accused persons also participated in the alleged offence. It has lastly been submitted that the petitioner has got no criminal antecedent and a similarly situated co-accused Abhinav Kumar @ Abinav Kumar has been granted the privilege of anticipatory bail by a coordinate Bench of this Court by order dated 24.06.2026 passed in Cr. Misc. No. 20400 of 2026.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances and the parity, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the

Patna High Court CR. MISC. No.49083 of 2026(2) dt.22-07-2026 3/3 satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Nawada P.S. Case No. 833 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
