The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 01/2021/Computer Reg. No. 11/21, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

153 litres of liquor is said to have been recovered from behind the house of the petitioner, concealed in a bush. It has been urged on behalf of the petitioner that such recovery cannot squarely be saddled upon the petitioner. The petitioner earlier was made accused in a case of similar nature, in which he has been granted bail.

Regard being had to the period of custody of the petitioner and the nature of offence, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ -II-cum-Special Judge, (Excise), Samastipur, in connection with Bibhutipur P.S. Case No. 01/2021/Computer Reg. No. 11/21.
