2. The petitioner seeks bail in connection with Hathua P.S. Case No. 02 of 2024, instituted for the offence punishable under Section 392 of the Indian Penal Code.
3. The prosecution case in brief is that the informant was posted on the post of R.O. in Bandhan Bank, Mirganj Branch. On 08.01.2024 at about 8:00 A.M. he proceeded for collection and collected total Rs. 50,735/- and kept in the pocket of paint and jacket as well as dickey of the vehicle. During the course of going to Ekdrago from Hathua, at about 2:20 P.M., near village Mudera, three persons riding on Motorcycle came and caught hold the informant and on the gun point snatched the aforementioned collected money, Mobile No. 9523448994,
Patna High Court CR. MISC. No.48828 of 2025(2) dt.08-08-2025 2/3 Vehicle No. BR04D9332, Tablet of Samsung Company bearing I.M.E.I. No. 352231113446152 and fled away.
4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has committed no offence and is in custody since 29.04.2025. The petitioner has been falsely implicated in this case on the confessional statement of coaccused Bittu Kumar Baitha, who has been granted bail by a Coordinate Bench of this Court vide order dated 02.08.2024, passed in Cr. Misc. No. 57283 of 2024. The other co-accused namely Rinkal Singh has also been granted bail by a Coordinate Bench of this Court vide order dated 26.04.2024, passed in Cr. Misc. No. 26165 of 2024. Learned counsel for the petitioner further submits that no recovery has been made from the possession of the petitioner and no T.I.P. has been done.
5. Learned A.P.P. for the State has vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case and the fact that the petitioner has been falsely implicated in this case on the confessional statement of coaccused Bittu Kumar Baitha, who has been granted bail by a Coordinate Bench of this Court vide order dated 02.08.2024, passed in Cr. Misc. No. 57283 of 2024, the petitioner above
Patna High Court CR. MISC. No.48828 of 2025(2) dt.08-08-2025 3/3 named has remained in custody for a considerable period and no recovery of any incriminating materials has been made from his possession and as such, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S. Case No. 02 of 2024.
