Petitioner, already in custody, seeks bail in connection with Bibhutipur P.S. Case No.209 of 2015, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that hearing the sound of firing the informant woke up, came out and saw the petitioner and other accused Dayanand Rai running away after the midnight and found his father killed by firearm due to enmity. Learned counsel for the petitioner submits that due to enmity, the petitioner has been named in this case. Learned counsel for the State submits that there is specific
Patna High Court Cr.Misc. No.9160 of 2018(2) dt.16-02-2018 2/2 allegation against the petitioner and FIR was also lodged within 2-3 hours of the occurrence.
