JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-08-2015 Heard the learned counsel for the petitioner, the learned counsel for the complainant/ informant and the learned Additional Public Prosecutor.
The petitioner seeks bail in a case under Section 406, 420, 467, 468 and 120B of the Indian Penal Code. The complainant/ informant alleged that the petitioner contacted the informant in August, 2011 and requested him to invest money in Kolkata Wire Industries Ltd. On such the informant and his relatives invested about Rs. 20 lacs. The informant and his relatives got some benefits for few months. A complaint was also lodged in SEBI which issued notice to the Directors of the Company.
It is submitted that petitioner is simply a clerk in the
Patna High Court Cr.Misc. No.32979 of 2015 (2) dt.19-08-2015 2/2 office of the Company. The complainant himself was an agent in the Company. The petitioner did not receive any farthing from the Company or any other customer or subscriber of the Company. The petitioner is in jail since 30.05.2015.
Learned counsel for the complainant/ informant and the learned Additional Public Prosecutor, however, opposed the prayer for bail.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Nagar P.S. Case No. 990/2014. (Prabhat Kumar Jha, J) BKS/- U T
