JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhagwanpur Hat PS Case No. 172 of 2017 registered under Sections 363 and 366A of the IPC.
The allegation in brief is that the petitioner enticed away the minor daughter of the informant.
Learned Counsel for the petitioner submits that the girl was recovered and she said that she wishfully eloped with the petitioner, though the girl is said to be of 15 years of age by the medical board and the petitioner is a man of 25 years. Charge-sheet has been submitted in this case Having considered the said facts and circumstances, the petitioner, namely, Hare Ram Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Siwan in connection with Bhagwanpur Hat PS Case No. 172 of 2017.
