The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Khutauna P.S. Case No. 41 of 2019 registered for the offence punishable under Sections 302, 201, 120(B) of the Indian Penal Code. The allegation is regarding the brother of the informant having been killed by the accused persons and his body was found hanging from a tree. It is the case of the informant that the said deceased brother of the informant used to mediate in between the informant and his in-laws as also his wife for the purposes of amicably settling their dispute. The learned counsel for the petitioner has submitted that the petitioner is not in any way connected to the alleged

No.46604 of 2019(3) dt.27-09-2019 2/2 crime and he is also not a member of the in-laws family of the informant, hence the motive being alleged does not in any manner demonstrate the complicity of the petitioner, as far as the present case is concerned. It is further submitted that there is neither any eye witness nor any evidence has been collected during the course of investigation so as to connect the petitioner with the alleged crime. The petitioner is having a clean antecedent and he is languishing in custody since 27.03.2019. Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Jhanjharpur, District-Madhubani in connection with Khutauna P.S. Case No. 41 of 2019, G.R. No. 428 of 2019.
