The petitioner seeks bail in connection with Excise Case No.5828/2017, arising out of Sahar P.S. Case No.184/2017 registered under Sections 30(A) and 36 of Bihar Prohibition and Excise Act, 2016 and Sections 272/273 of the Indian Penal Code. 40 liters of country made liquor is said to have been recovered from the hut of the petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. Hut of the petitioner is inhabited by his several family members. One Excise case was

Patna High Court Cr.Misc. No.7584 of 2018 (2) dt.13-02-2018 2/2 lodged against the petitioner, in which, he has been enlarged on bail. The petitioner has been languishing in custody since 03.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhojpur at Ara, in connection with Sahar P.S. Case No.184/2017.
