The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 287, 288, 353 and 427 of the Indian Penal Code.

The prosecution case, as per written report of Kailash Kumar, the Junior Electrical Engineer, Bakhri, is that Electric workers Union were on strike. Subsequently, the electric workers of Electric Supply Department, Bakhri also joined the strike. It is also alleged that the said electric workers including the petitioner disrupted electric supply, as a result of which the Department suffered a loss of Rs.8000/-.

It is submitted by the learned counsel for the petitioner that the allegation is based on suspicion and the accusation has

Patna High Court Cr.Misc. No.25176 of 2016 (2) dt.21-06-2016 been levelled against the entire workers Union. A statement has been made in paragraph 3 of the application that the petitioner is a daily wages employee in Electric Supply Department and has no criminal antecedent.

Considering the aforesaid facts, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Begusarai in Bakhri P.S.Case No. 40/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
