Petitioner, already in custody, seeks bail in connection with Gopalpur P.S. Case No.268 of 2017, registered under Sections 399 and 402 of the Indian Penal Code as well as under Sections 25(1-b)A, 26/35 of the Arms Act.

Allegation in brief is that police on information reached and apprehended many persons and arms were recovered from some of them but only iron rod is said to have been recovered from possession of the petitioner. It is contended that petitioner is a labourer and one iron rod is said to have been recovered from his possession but no arms and this petitioner before institution of the present case

Patna High Court Cr.Misc. No.20378 of 2018(2) dt.06-04-2018 2/2 had no criminal antecedent, only after being apprehended in this case, the petitioner was made accused in another case. Having considered the aforesaid facts and circumstances, petitioner Md. Shahbul Sheikh @ Md. Shahbur Sheikh @ Shahbul Sheikh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XIV-cum-Additional Chief Judicial Magistrate, Patna in connection with Gopalpur P.S. Case No.268 of 2017. (Arun Kumar, J) S.KUMAR/- U T
