The petitioner seeks bail in a case registered for the offence punishable under Sections 143 and 436 of the Indian Penal Code.
The allegation against the petitioner and seven others is to have set fire in the dwelling house of the informant which caused damage to the house.
It is submitted by the learned counsel for the petitioner that there is no specific allegation of overt act against the petitioner. The petitioner has been in custody since 6.11.2013. After investigation chargesheet has already been submitted and there is no chance of tampering with the witnesses.
Learned counsel for the State submits that petitioner has also criminal antecedents.
Considering the facts and circumstances of this case, the above-named petitioner is directed to be
Patna High Court Cr.Misc. No.33018 of 2015 (2) dt.20-08-2015 2 / 2 released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi at Patna, court concerned in Dhanarua P.S. Case No. 88 of 2005 after framing of charge with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence on two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
