The State is represented by the learned APP.
Patna High Court CR. MISC. No.2946 of 2021(2) dt.30-07-2021 2/3 The petitioners seek bail in anticipation of their arrest in connection with Jogapatti P.S. Case No. 109 of 2020, dated 06.04.2020, instituted for the offences under Sections 341, 323, 324, 307, 354B, 379, 436, 447, 504 and 506/34 of the Indian Penal Code.
Eleven persons have been named accused in this case out of whom nine are the petitioners in the present application.
The petitioners are alleged to have assaulted and injured five members of the prosecution party. It has been submitted on behalf of the petitioners that there is a counter version of the occurrence as well and in the case from the side of the accused persons, four persons have been injured. It has further been submitted that the parties are agnates and there is a dispute with respect to 1.87 decimals of land which was purchased by Lal Bahadur Ram and Anita Devi through a registered sale-deed executed by one Reena Devi in the year 2019.
The injuries suffered by the victims of the subject F.I.R. as well as of the counter case, it has been argued, are
Patna High Court CR. MISC. No.2946 of 2021(2) dt.30-07-2021 3/3 all simple in nature. The members of the prosecution side, who were made accused in the counter case, have already been released on bail by the Court below.
Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Jogapatti P.S. Case No. 109 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
