The petitioner seeks bail in anticipation of his arrest in connection with Chanpatia (Kumarbag) P.S. Case No. 460 of 2020, dated 09.09.2020, instituted for the offences under Sections 341, 323, 324, 307, 327, 387, 379, 504 and 506/34 of the Indian Penal Code. Two persons are said to have been injured in the occurrence. The petitioner is said to have given a sword blow on the informant. One of the victims of this case has

Notwithstanding the afore-stated facts including that the person who has caused the loss of vision of one of the victims is another accused person, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below, after taking into account all the facts, shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
