JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 08.06.2015 on the accusation that he took Rs. 4,52,600/- from the informant for construction of school building but did not complete his work and digested the entire amount.

The contention on behalf of the petitioner is that the informant did not make full payment to the petitioner and as a matter of fact, petitioner got some amount through cheques and for the aforesaid amount he had already completed the work in question.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.34452 of 2015 (2) dt.21-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 233 of 2013.
