The petitioner is languishing in custody in a case registered for the offences punishable under Sections 354, 354(A), 354(B), 354(D) of the Indian Penal Code and Sections 8, 12 of the POCSO Act. It is alleged against the petitioner that he outraged the modesty of the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

It is further submitted that petitioner resides at the house of the informant as tenant with his parents but the victim in her 164 Cr.P.C statement did not recognize the petitioner and stated that one person tried to disrobe her which suggests that a concocted and false story has been planted against the petitioner. The petitioner has still not been put on T.I. parade. The petitioner is languishing in custody since 15.05.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that victim is minor and there is specific accusation against the petitioner that he outraged the modesty of the victim.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-
