JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 27.04.2015 in connection with Danapur P.S. Case No. 119 of 2013 for the offences instituted under Section 379/34 of the IPC. The accusation is of stolen away the Tractor and trolley of the informant by some unknown persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.04.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. The petitioner is not named in the FIR nor he has been put on T.I. Parade nor there is any recovery from conscious possession of the petitioner. It is
Patna High Court Cr.Misc. No.36234 of 2015 (3) dt.06-10-2015 2/2 further submitted that the petitioner may be released after completion of nine months in custody from 27.04.2015. On behalf of the State it has been submitted that the name of the petitioner has appeared in course of investigation. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named may be released on bail after completion of nine months in custody from 27.04.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna, in connection with Danapur P.S. Case No. 119 of 2013.
