ANJANA MISHRA ORAL ORDER 23-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being the Panchayat Secretary of Dumri Bhagrwa Gram Panchayat apprehends his arrest in connection with a case registered for the offences punishable under Sections 409/420/34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that a substantial portion of the work had been completed during his tenure as Panchayat Secretary. In order to ascertain the same, the case diary had been called for on the earlier occasion.

Learned counsel for the State after perusal of the case dairy

Patna High Court Cr.Misc. No.11818 of 2016 (5) dt.23-06-2016 P2/2 submits that it has come on record that about 85% of the work was, in fact, completed during the tenure of the petitioner and the rest work would be completed if the petitioner is so permitted. In view of the aforementioned facts and circumstances and that he had been transferred in the year 2013 itself prior to the completion of the work and also because a substantial portion of the work had been completed, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Dhanaha Police Station Case No. 103/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
