The petitioner seeks bail in a case registered for the offences punishable under sections 147, 148, 149, 341, 323, 307, 379, 506 of the Indian Penal Code later on section 302 I.P.c. was also added.
The petitioner is named in the first information report along with others but omnibus allegation of assault has been leveled against the petitioner and others.
Learned counsel for the petitioner submits that similarly situated co-accused Anuj Rajak, Chabila Rajak, Bipin Rajak, Shankar Rajak, Guddu Kumar @ Gudda Kumar, Bablu Rajak, Arjun Rajak, and Chhotu Kumar @ Adarash Rajak have
Patna High Court Cr.Misc. No.32719 of 2015 (3) dt.09-11-2015 2/2 already been allowed bail by a coordinate Bench of this Court vide Cri. Misc. No. 4605 of 2015 and Cri. Misc. No. 48955 of 2015 and as such the petitioner also deserves sympathetic consideration to which the learned A.P.P. does not dispute. In the facts and circumstances as stated above the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri R.K. Mishra, J.M. Ist Class, Munger in Sangrampur P.S. Case No. 102 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
