JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Suppi P.S. Case No. 26/2019, disclosing offences under Sections 341, 323, 324, 307, 447, 349, /34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant on his head by means of sword and when her wife came to save him, she was also assaulted by the accused persons.

Submission of learned counsel for the petitioner is that prior to lodging of the present case, a case has been lodged by the petitioner against the informant and others for assault to the petitioner and although there is allegation of assault, however, the injury caused to the informant was found to be simple in nature, which will appear from annexure -3 of the

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Suppi P.S. Case No. 26/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
