2. The petitioner is apprehending his arrest in connection with Halai P.S. Case No. 33 of 2026 registered for the offence under Sections 105 and 106 of the B.N.S., lodged on 21.02.2026 by the informant, Indu Devi.

3. As per the prosecution story, the informant alleged that her minor daughter, Raushni Kumari, nine years died due to electrocution as live wire was present in the field of the petitioner. This led to the F.I.R.

4. Learned counsel for the petitioner submits that nothing is on record to show that the wire belonged to him and deceased girl being from his own village, he himself is in a state of shock. Further, he do not have criminal antecedent and would like to show his solidarity with the family. Thus, without accepting the allegation or outcome of the present petition, the petitioner intend to pay Rs.1,00,000/- (Rupees One Lakh) to the

Patna High Court CR. MISC. No.47604 of 2026(2) dt.22-07-2026 2/3 informant (Indu Devi) by Demand Draft issued by the local branch of the State Bank of India/any Nationalized Bank to be submitted at the time of execution of bail bond.

5. Learned APP opposes the prayer submitting that allegation of using live wire in the field is there against the petitioner.

Considering the submissions of the parties as also that he do not have criminal antecedent and/is ready to face the investigation/cooperate in trial, in that aforesaid background, this Court is inclined to extend him the privilege of anticipatory bail subject to payment of Rs.1,00,000/- (Rupees One Lakh) to the informant (Indu Devi) as undertaken by the learned counsel for the petitioner through Demand Draft issued by the local branch of the State Bank of India/any Nationalized Bank to be submitted at the time of execution of the bail bond and the same shall be handed over to the informant (Indu Devi) after checking credentials.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Shahpur Patori, Samastipur, in connection with Halai P.S. Case No. 33 of 2026

Patna High Court CR. MISC. No.47604 of 2026(2) dt.22-07-2026 3/3 subject to the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Voter Id/Driving License/Pan Card) to show his/her bona fide;

(ii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the investigation;

(iii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
