The petitioners are aggrieved by the action of the respondents in adopting pick and choose method in sending the teachers for in service training.

Learned counsel for the petitioners submits that the petitioners would be entitled to the benefit of Matric Trained Scale as ignoring their seniority others have sent for in service training. He placed reliance of the decision of this Court passed in C.W.J.C. No. 7322 of 2017.

This Court has occasion to decide the similar issue on 11.04.2018 in C.W.J.C. No. 7322 of 2017.

Considering the aforesaid, the writ application is disposed of with a direction to the respondents, particularly, respondent no.4, to consider the case of the petitioners in the

Patna High Court CWJC No.14589 of 2019(2) dt.23-07-2019 3/3 light of the decision passed in C.W.J.C. No. 7322 of 2017 and take appropriate decision at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order.

In case, on scrutiny, it is found that the case of the petitioners is similar to Abdus Samad, the petitioner in C.W.J.C. No.7322 of 2017, similar treatment should be extended to these petitioners also.
