2. The petitioner apprehends his arrest in connection with Gopalganj P.S. Case No. 85 of 2024 registered for the offence punishable under Sections 420, 406, 467 and 471/34 of the Indian Penal Code.

3. Though, the allegation is that the petitioner and his sons have cheated Rs. 22 lakhs approx from the informant for providing a job but the learned counsel for the petitioner submits that the petitioner being the brother has been falsely implicated and his son Vivek Kumar is involved in these kind of illegal activities.

4. Learned APP appearing for the State opposed

Patna High Court CR. MISC. No.57948 of 2024(3) dt.11-12-2024 2/3 the application of the petitioner.

5. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj / concerned Court below in connection with Gopalganj P.S. Case No. 85 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

6. The co-accuse of the present case one Birbal Singh, the father of the present petitioner was granted bail by this Court vide order dated 24.7.2024 passed in Cr. Misc. No. 50275 of 2024.

7. The following direction was given to the Superintendent of Police, Gopalganj vide order dated 24.07.2024:- The Superintendent of Police, Gopalganj will take all steps for arrest of the remaining accused persons.

8. On enquiry from the learned counsel for the petitioner, it has been submitted by him that the Vivek Kumar is still has not been arrested.

9. In these circumstances, the Superintendent of

Patna High Court CR. MISC. No.57948 of 2024(3) dt.11-12-2024 3/3 Police, Gopalganj is directed to file a show cause as to why Vivek Kumar has not been arrested till date.

10. List this case after six weeks.

11. It is expected that before filing the show cause, the Superintendent of Police, Gopalganj take all steps for arresting the accused Vivek Kumar.

12. Mr. Jharkhandi Upadhyay, learned APP for the State will assist this Court in the present case and the learned counsel for the petitioner will handover a copy of the brief to the learned APP for the State.
