The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The widow of deceased made allegation that she heard that her husband was lying injured in pool of blood in front of the gate of Darbhanga jail. The informant suspected that the petitioner and other accused persons must have killed her husband on account of business rivalry.

There appears no eye witness of the occurrence. From a perusal of order of learned Sessions Judge, it appears that the witnesses examined during the course of investigation only suspected hands of the petitioner in killing the deceased. Considering the facts aforesaid and the nature of
