The petitioner is accused in connection with Chowk P.S. Case No. 368 of 2017 (Special Case No. 8121 of 2017), registered under Sections 272 & 273 of the Indian Penal Code and Section 30(a)(c)D of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving secret information about selling of illicit liquor by Rohit Agrawal and the petitioner, the informant being the Police officer of Chowk Police Station, Patnacity raided the house of Rohit Agrawal, but Rohit Agrawal succeeded to flee away from the house. On search, 120 pouches of country made liquor recovered. The
Patna High Court Cr.Misc. No.16711 of 2018(2) dt.29-03-2018 2/2 father of Rohit Agrawal was present in the house, who disclosed that the said liquor was supplied by this petitioner. Learned counsel for the petitioner submits that it would appear from the F.I.R that petitioner was not apprehended to the house of co-accused Rohit Agrawal. The petitioner has falsely been implicated in this case mere on suspicion. The petitioner has no criminal antecedent is in custody since 30.12.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Patna in connection with Chowk P.S. Case No. 368 of 2017 (Spl. Case No. 8121 of 2017).
