JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner being rice miller, failed to deliver rice as per agreement executed between the BSFC as well as the petitioner and allegedly, he defalcated the government money to the tune of Rs. 6455231/- The contention on behalf of the petitioner is that even if, prosecution story assumed to be true, then also, it is only a case of breach of agreement and moreover, several co-accused of different cases, having similar allegation, have already been granted privilege of bail by different benches of this court.
