JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 15.11.2017, seek bail in Khanpur PS Case No. 134 of 2017 registered under Sections 120(B), 201 and 302/34 of the IPC.
The allegation in brief is that earlier a case was lodged by the informant side against the petitioner side and petitioners were pressurizing to withdraw the case and when the informant side made complaint to the police thereafter in the evening the accused persons dragged away the informant's daughter and in the morning her dead body was found.
Learned Counsel for the petitioners submits that there was enmity between both sides, no information with regard to taking away the girl was given by the informant on the day of occurrence, the petitioners have falsely been implicated in this case, similarly situated another co-accused Sheela Devi has been admitted to bail by this Court in Cr. Misc. No. 4177 of 2018 and the petitioners have no criminal antecedent except one complaint case. Having considered the said facts and circumstances, the petitioners, namely, Dilip Mahto @ Dilip Kumar Mahto and Amarjit Mahto @ Amarjit Prasad Singh are directed to be released
Patna High Court Cr.Misc. No.18356 of 2018 (2) dt.30-03-2018 on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Samastipur in connection with Khanpur PS Case No. 134 of 2017. (Arun Kumar, J.) Snkumar/- U T
